Hamilton | Appotive LLP

Construction Law

Our firm acts on behalf of owners and lenders, developers, builders, engineers, design professionals, general contractors and sub-trades, and suppliers in all aspects of construction law. Our approach is a team approach. We work closely with our clients in order to deliver effective advice and concrete solutions.

Our services include drafting and negotiating construction contracts and agreements, reviewing contracts and bid packages, all with a view to best managing our client’s risk and preventing disputes. When a dispute does arise, our broad experience means that we are able to vigorously defend our clients’ interests.

When appropriate, we encourage mediation and other methods of alternative dispute resolution, which often results in the preservation of commercial relationships.

In addition to litigating and defending construction lien actions, we regularly deal with delay claims, claims arising in negligence and breach of trust actions, as well as tender bid claims. We also provide counsel to bankruptcy and construction lien trustees.

Our lawyers regularly attend Continuing Legal Education seminars on all areas of construction law, and have lectured at seminars on topics such as construction liens, breach of trust, and the tendering process. Our firm is a member of the Ottawa Construction Association, the Greater Ottawa Home and Builders Association, and the Ontario Construction Association.
